Data Protection Statement

Commitment to the protection of personal data

The protection of our participants' personal data is important to us. A breach of data protection can result in a loss of trust by participants and the public and jeopardize the organization of events. We therefore act in accordance with the European Data Protection Ordinance (GDPR) and the Federal Data Protection Act (DPA), insofar as the relevant provisions are applicable to individual cases.

We have commissioned Endu to provide timekeeping and similar services and consequently also refer to their data protection regulations.

Responsible persons, contact details

The Lugano Bike Emotions Association, CP 25, 6962 Viganello, Switzerland, is responsible for collecting and processing personal data in the context of the event. For the processing of the account data, the third party who performs the time measurement is responsible and the data protection declarations and general terms and conditions of the respective third party company apply.

Legal basis

The legal basis for the processing of personal data is Article 6 para. 1 lit. a GDPR or Article 13 para. 1 DPA. If the data is processed for the performance of a contract with the data subject, including pre-contractual measures, the legal basis is Art. 6 para. 1 lit. b GDPR or Art. 13 para. 2 lit. a DPA. If the processing is necessary for the protection of a legitimate interest of our company or a third party, the legal basis for the processing is Art. 6 para. 1 lit. f GDPR or Art. 13 para. 1 DPA. This applies, for example, to marketing, provided that you have not objected to the use of your data for marketing purposes.

Legitimate interests may also include, in particular:

- the operation and administration of the website;

- the provision of services and/or information to you;

- the prevention and detection of fraud and crime;

- the processing of personal data for administrative purposes;

- assert, exercise or defend legal claims;

- responding to requests for information;

- informing the public and interested parties;

- the execution of direct marketing measures.

We have many of the following data because you have made them available to us (e.g. through registration, etc.). If you conclude a contract with us by obtaining a service, you must provide us with certain data, such as personal data, because of your contractual obligation. If it concerns behavioural data or preferences, you may object to the processing of the data or withhold your consent.

 

Data processing for the realisation of the event

For registration and realisation of the event, participants are asked for their surname, first name, year of birth and address as well as e-mail address as compulsory data. Other data is collected only on a voluntary basis and only if necessary for the provision of a further service. We process this data for the purpose of running the running event, including sending information on participation and starting documents (digital race packet), as well as a request for feedback after the event. The processing takes place for the performance of the contract (Art. 6 para. 1 lit. b GDPR or Art. 13 para. 2 lit. a DPA or Art. 31 para. 2 lit. a nLPD) that you have concluded with us, as well as on the basis of our overriding or legitimate interest (administrative purposes; Art. 6 para. 1 lit. f GDPR or Art. 13 para. 1 DPA or Art. 31 para. 1 nLPD).

Creation and publication of start lists and rankings

The surname, first name, year of birth, place of residence, category and race time will be published in the rankings. The full address will not be published.

At various points in the event, times will be recorded as participants pass by and electronically assigned to the participant crossing the finish line via a transponder. From this data set, the lap and/or course times of the participants will be determined and from these the results lists will be created. This data will be published during and after the event on the website, on the Internet and, if necessary, in the press. The publication of rankings on the Internet takes place on the organiser's website and on the website of the timing providers (e.g. Endu).

The purpose of publishing data is to compare participants with each other in a manner typical of competitions. Data is processed on the basis of a legitimate interest (information of the public and data subjects; Art. 6 para. 1 lit. f GDPR or Art. 13 para. 1 DPA or Art. 31 para. 1 nLPD). The runner may request that his or her name be removed from the list of results visible to the public after the end of the event.

If you register for an event via our website or purchase products via our online shop (existing customers) and/or provide us with your e-mail address, we will use it to send you a newsletter with direct advertising for our similar products and services, unless you object. You can object at any time by sending us an e-mail or writing to us.

Your data will be used exclusively for sending the newsletter.

For the processing of your data, you will be asked for your consent when registering and reference will be made to this data protection declaration. To subscribe to the newsletter, simply enter your e-mail address. Optionally, we ask you to state your surname, first name and gender for the purpose of a personal address in the newsletter.

The newsletter is sent by the postal service provider ‘Mailchimp’, a platform for sending newsletters. The receipt of our newsletter can be cancelled at any time, i.e. consent can be revoked.

The sending of newsletters for the sale of goods or services is based on the legal basis of legitimate interest (direct marketing; Art. 6 para. 1 lit. f GDPR or Art. 13 para. 1 LPD or Art. 31 para. 1 nLPD). If you register for a newsletter on our website, processing is based on your consent and thus on Art. 6 para. 1 lit. a GDPR or Art. 13 para. 1 DPA or Art. 31 para. 1 nLPD. You may revoke this consent at any time by unsubscribing from the newsletter. For this purpose, there is an unsubscribe link in every newsletter. Revocation does not affect the legality of the data processing operations already carried out.

Automated decision-making in individual cases, including profiling

We do not carry out any automated decision-making in individual cases within the meaning of Article 22 GDPR or automated individual decision-making within the meaning of Article 21 nLPD for the purpose of establishing and implementing the business relationship with you.

 

Data saving and data retention

We process only as much data as is absolutely necessary for the intended purpose.

We delete data that is no longer required, unless there is a legal obligation to retain it or we are entitled to continue to retain it on the basis of another legal basis or our overriding interest.

 

Outsourcing of data processing

Companies working for us or on our behalf for the organisation and execution of events, the processing of registrations (online, offline), the management of participant data, collection, timing, results service, start number processes, participant recruitment and to process information and data work on our behalf and for our purposes. In accordance with the law, we are obliged to monitor the processing of data by these companies and to oblige them not to process them for their own purposes or to pass them on to unauthorised third parties.

 

Disclosure of data to third parties

We only pass on personal data to third parties (photo service, timekeeping, newspapers, TV stations, internet services, etc.) who contractually undertake to process the data only for a specific, clearly defined purpose and not to pass it on to unauthorised third parties (e.g. sending advertising in the start package or delivery of advertising mailings).

If we are legally obliged to do so, we obtain the runner's consent before passing on personal data to third parties who process the data for their own purposes (the provision of their own services) at the time of registration.

If permitted by the Data Protection Act, we assume consent for the disclosure of your personal data such as surname and first name, private address (street, postcode and city), date of birth, telephone number and e-mail address to partners (e.g. photo and video service), provided that we do not prohibit the disclosure of the data by means of a notification to the postal or e-mail address given below. These partners may use the data for their own services or for advertising purposes and, in the case of sponsors, for specific purposes and telephone campaigns in connection with the current event.

You may revoke your consent to the transfer of data to third parties at any time.

 

Rights of the participant

You have the right to request information about the data concerning you that is processed. You also have the right to request the rectification, deletion or restriction of the processing of your data and, if applicable, the right to data transfer. You can also oppose the use of your data for marketing purposes.

These rights exist to the extent that there are no legal retention obligations or other legitimate interests in conflict with the request. You also have the right to appeal to the competent data protection supervisory authority.

Consent to data processing can be revoked at any time.

Data integrity

We take appropriate technical and organisational measures to protect the data of our participants, in particular against intentional or accidental destruction or falsification and against access by unauthorised third parties. If data is processed by an outsourcing partner, we ensure that it complies with data security requirements, which we constantly monitor and improve.

 

Transmission of data to third-party companies

The companies commissioned by us are as follows:

- Dicasero Sport Città di Lugano (registration management, promotions and newsletter)

- Endu (timekeeping, SMS, etc.)

- OKK (promotions and newsletter)

 

Contact data

In principle, participants' data and addresses are not made available to third parties. We do, however, reserve the right to pass on address data to our partner ÖKK and other sponsors for specific marketing purposes, as the realisation of sporting events of this kind is only possible thanks to their contribution.

Photos and videos

 

Photographs and video footage will be taken during the Lugano Bike Emotions event. The organisers, ÖKK and other directly involved partners as well as the media reporting on the sporting event may use the photo and video material for their own purposes, in particular for social media channels, websites, image galleries and possibly also printed products. Individual persons may be recognised in the photos and videos. With their entry, participants accept this condition without receiving any remuneration.

 

Please note that at the end of the event, the photos and videos taken during the races, tours and other scheduled activities will be uploaded to special platforms so that all participating persons can view and download them free of charge. Both the organisers and ÖKK have the right to use the uploaded photos and videos. The transmission of images to third parties is not permitted.

 

By registering, you automatically give your consent to the appearance in photos and videos taken during the Lugano Bike Emotions event and to the uploading of such material onto an appropriate platform.

 

Deletion of data

All participating persons have the right at any time to prohibit the organisers and/or sponsors from using their address or images in which they appear without stating a reason.

Withdrawal of consent must be made in writing to iscrizioni@luganobe.ch and must include details of the person and/or material to be deleted.
